• permit the Services to be used by anyone other than yourself;
• use the bandwidth and storage resources provided by us in an unreasonable and disproportionate manner. We monitor usage to ensure fair distribution of resources among all of our customers. In the event that your bandwidth or storage usage exceeds what we view in our sole discretion is reasonable and proportionate, we reserve the right to take appropriate measures, including but not limited to implementing bandwidth throttling, imposing storage limits, suspending or terminating your access to the services, in whole or in part, without liability;
• circumvent or otherwise interfere with any authentication or security measures of the Services, or otherwise interfere with or disrupt the integrity or performance of the Services, including doing anything to, or using the Services in a way that may, cause the Services to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Services is in any way impaired, including overloading, flooding, spamming, mailbombing or crashing; and

In no case shall Samsika, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Samsika and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision will nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date will survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site/ app.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 21 – REEFUND POLICY AND TERMS OF USE

 

1. Unless otherwise expressly provided and agreed by Samsika in writing, full payment for purchasing a Course/ Service and/or participation in a Seminar/ Course, shall be mandatory and required at the time of registration. For all the Course(s)/ Service(s)/ Seminar(s)/ Lectures(s), without any trial period, no refund shall be allowed for any reason whatsoever.
2. In the event the Course/ Service consists of a trial period, the access for such trial period shall be made available only after the receipt of the full payment. During such trial period, upon a request received from the User/ Customer, Samsika may at its sole discretion and in accordance with the applicable refund policy for the particular Course/ Service/ Seminar/ Lecture, choose to refund the fees paid by the Customer, subject to the deduction(s) of such applicable charges, including but not limited to marketing and administrative expenses, as Samsika may deem fit, from time to time. Once the trial period lapses, there will be no refund allowed for any reason whatsoever.
3. It is the sole responsibility of the User/ Customer to check the accuracy of and/ or evaluate the suitability and/or relevance of the Course(s)/ Service(s)/ Seminar(s)/ Lecture(s) elected.
4. The User/ Customer shall be exclusively responsible for obtaining and maintaining any equipment(s) and/or ancillary service(s) that may be needed to access such Course(s)/ Service(s)/ Seminar(s)/ Lecture(s) offered by Samsika and/or to access the payment gateway. The User/ Customer shall be solely responsible/ liable for ensuring that such equipment(s) and/ or ancillary service(s) are compatible with the Samsika’s Website/ Platform/ App. The User/ Customer shall be solely responsible/ liable for all the charges incurred in connection with the use of Samsika’s Website/ Platform/ App for accessing the said Course(s)/ Service(s)/ Seminar(s)/ Lecture(s), including but not limited to the charges of the equipment(s) and/or ancillary service(s).
5. Purchase/ enrolment once made to a particular Course/ Service/ Seminar shall be strictly non-transferable.
6. The User/ Customer(s) enrolling / participating in the Live Seminar(s)/ Lecture(s) organised by Samsika shall be provided access to such event(s) via email. The User/ Customer(s) agrees that such access shall not be shared with any third party, in any manner.
7. The User/ Customer agrees that failure to pay the applicable fees towards the Course(s)/ Service(s)/ Seminar(s) offered by Samsika, shall result in withdrawal of the User/ Customer’s access to such Course(s)/ Service(s)/ Seminar(s)/ Lecture(s). The User/ Customer understands that Samsika at its sole discretion may limit and/or suspend and/or terminate the use to such Course(s)/ Service(s)/ Seminar(s)/ Lecture(s).
8. Samsika reserves its right to cancel/ reschedule any of its Course(s)/ Service(s)/ Seminar(s)/ Lecture(s) and/or to alter the content of the same, at its sole discretion. Samsika further reserves the right to modify and/or discontinue all such Course(s)/ Service(s)/ Seminar(s)/ Lecture(s), at its sole discretion. The User/ Customer agrees that Samsika is not responsible / liable for any such modification and/or discontinuation and/or termination.
9. To make payment for any of the Course(s)/ Service(s)/ Seminar(s) offered by the Samsika through its Website/ any Platform/ App, the User/ Customer shall have internet access and an active valid accepted payment method as more particularly indicated under the “Payment methods”. Samsika does not store any of the payment detail(s) or such other information restricted by the Reserve Bank of India (“RBI”).
10. Samsika has partnered with payment gateway for the payment towards Course(s)/ Service(s)/ Seminar(s)/ Lecture(s) offered. By using such third-party payment gateways/ providers, the User/ Customer agrees to abide by the terms and conditions of such payment gateways/ providers. The User/ Customer agrees that it shall indemnify and not hold Samsika liable in any manner, in case the payment gateways/ providers stores any information pertaining to the User/ Customer. Any loss of such information or any loss incurred to the User/ Customer due to the usage of such information shall be solely incurred by the User/ Customer and Samsika shall not be liable for the same in any manner whatsoever.
11. The User/ Customer agrees to pay all the applicable fees for the payment(s) made through the Samsika’s Website/ Platforms/ App. All applicable taxes are calculated based on the billing information provided by the User/ Customer at the time of enrolment and/or purchase, as applicable. Depending upon where the User/ Customer transacts with Samsika and/or the type of payment method used and/or where the payment was issued, the transaction may be subject to foreign exchanges fees or exchange rates. Samsika does not support all payment methods and/or currencies and/or locations for payment.
12. Samsika urges the User/ Customer to be cautious while making payments and during financial transactions.
13. Nothing contained in these terms shall be construed to obligate Samsika to maintain and support its Website/ Platform/ App and / or its Course(s)/ Service(s)/ Seminar(s)/ Lecture(s) or any part/ portion thereof and/or any associated service(s).
14. Samsika shall not be responsible/ liable to the User/ Customer in the event of non-availability of its Website/ Platform and/or its Course(s)/ Service(s)/ Seminar(s)/ Lecture(s) or any part/ portion thereof occasioned by an Act of God, war, disease, epidemic and other natural calamities, riot, strike, lockout, man-made disaster and/or any other cause whatsoever, which is beyond the control of Samsika.
